Silver Reef Silver Mine Mill Site on 07/26/2009



We were on our mining claim in the San Bernardino Mountains on the 26th of July which is near the Silver Reef Silver Mine. A friend of mine had the mill site at the Silver Reef Mine and they mined a lot of silver there. Now as you can see the building that were once there are gone and the remaining building will not be around much longer either.

The fight is still on against our Suction Dredging rights!

As many of you are already aware, Senate Bill 670
(anti-suction dredging legislation) was overwhelmingly passed by
the California Senate several days ago. The bill will now go to the
California Assembly. Our staggering defeat in the Senate has placed
our lobbyists into a full regroup mode.

All of this legislative activity (which will affect future dredging
seasons) is happening under the darker cloud of ongoing litigation
against suction dredging (which could have an impact upon our present
season) in California. Our adversaries have filed a Motion asking
the Court to prevent the Department of Fish & Game "from spending
any funds allocated from the State of California's General Fund on
any activities which allow suction dredging to occur under the
Department's current regulations." This Motion will be heard by the
Court in less than 2 weeks!

We are fighting the biggest, hardest battles our industry has ever
faced. You guys have always been there to help in the past.

Now we need you more than ever!

Letter in Opposition to California SB 670

Re: OPPOSE SB 670; suction dredge equipment permits.

Dear Senator Wiggins:

This letter is to inform you of my opposition to your bill SB 670. Your bill seeks to shut down a legal activity that myself and my family is engaged in. Why are you doing this when you know that there is an Environmental Impact Review already in progress on this issue?

It seems that suction dredge gold mining has been under constant attack since the court ordered the environmental review to be undertaken to determine what effect, if any that suction dredge gold mining has upon salmon spawning habitat. The Governor vetoed a bill in 2007 which dealt with this very same issue. The proponents of that bill have continued to attack us and falsely blame us on the decline of the salmon in the Klamath River.

Suction dredge mining is already limited to a short season that keeps the miners out of the rivers while there remains any possibility that we could dig into salmon redds. There are numerous studies which show suction dredge gold mining causes no harm to fish when they are not spawning.

If passed, your bill will destroy a vibrant part of California history, ruin the economies of rural counties and deny citizens our property rights. The allure of this activity is the same as that which brought the 49ers to California during the Gold Rush. It is part of our heritage.

This is not an inexpensive hobby or avocation. I spend a lot of money on equipment, lodging and contribute to the economy of mostly rural California. The average small-scale dredger spends an estimated $3,000 or more per month when mining. Much of this money is spent in local, rural economies where mining is popular. Also, the tax revenues generated from expenditures such as fuel, groceries, camping, and mining supplies, means that rural counties and the State of California benefit as well.

An often overlooked fact about suction dredge mining is that many of us have federal mining claims. Your bill, if passed, would violate our private property rights and would result in a very significant “takings” liability against the state. There have been numerous Federal and state court cases which have upheld these federal property rights.

An act to add Section 5653.1 to the Fish and Game Code, relating to
dredging, and declaring the urgency thereof, to take effect immediately.

SB 670, as introduced, Wiggins. Vacuum or suction dredge
equipment.
Existing law prohibits the use of any vacuum or suction dredge
equipment by any person in any river, stream, or lake of this state
without a permit issued by the Department of Fish and Game. Under
existing law, it is unlawful to possess a vacuum or suction dredge in
areas, or in or within 100 yards of waters, that are closed to the use of
vacuum or suction dredges. A violation of the permit requirement is a
misdemeanor. The department is authorized to close areas otherwise
open for dredging and for which permits have been issued if there is an
unanticipated water level change and the department determines that
closure is necessary to protect fish and wildlife resources. Existing law
requires the department to adopt regulations to implement certain of
the vacuum or suction dredge equipment requirements and authorizes
the department to issue regulations with respect to other requirements.
Existing law requires that the regulations be adopted in accordance with
the requirements of the California Environmental Quality Act (CEQA).
CEQA requires a lead agency, as defined, to prepare, or cause to be
prepared by contract, and certify the completion of, an environmental
impact report on a project, as defined, that it proposes to carry out or
approve that may have a significant effect on the environment, or to
adopt a negative declaration if it finds that the project will not have that
effect. The act exempts from its provisions, among other things, certain
types of ministerial projects proposed to be carried out or approved by
public agencies, and emergency repairs to public service facilities
necessary to maintain service.
This bill would prohibit the use of any vacuum or suction dredge
equipment in any river, stream, or lake until the director of the
department certifies to the Secretary of State that (1) the department
has completed an environmental review of its existing vacuum or suction
dredge equipment regulations as ordered by the court in a specified
court action, (2) the department has transmitted for filing with the
Secretary of State a certified copy of new regulations, and (3) the new
regulations are operative.
This bill would declare that it is to take effect immediately as an
urgency statute.

Vote: 2⁄3. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.
The people of the State of California do enact as follows:


SECTION 1. Section 5653.1 is added to the Fish and Game
Code, to read:

5653.1. (a) (1) The program of the department governing the
issuance of permits to operate vacuum or suction dredge equipment
is a project pursuant to the California Environmental Quality Act
(Division 13 (commencing with Section 21000) of the Public
Resources Code) and may proceed only if the department has
caused to be prepared, and certified the completion of, a
programatic environmental impact report on the project.
(2) The issuance of permits pursuant to Section 5630 is not a
ministerial act pursuant to the California Environmental Quality
Act (Division 13 (commencing with Section 21000) of the Public
Resources Code), and permits shall not be issued by the department
pursuant to the program when a subsequent or supplemental
environmental impact report is required to be prepared and certified
pursuant to Section 21166 of the Public Resources Code.
(3) This subdivision does not constitute a change in, but is
declaratory of, existing law.
(b) Notwithstanding Section 5653, the use of any vacuum or
suction dredge equipment in any river, stream, or lake of this state
is prohibited until the director certifies to the Secretary of State
that all of the following have occurred:

SB 670 — 2 —

(1) The department has completed the environmental review of
its existing suction dredge mining regulations, as ordered by the
court in the case of Karuk Tribe of California et al. v. California
Department of Fish and Game et al., Alameda County Superior
Court Case No. RG 05211597.
(2) The department has transmitted for filing with the Secretary
of State pursuant to Section 11343 of the Government Code, a
certified copy of the new regulations adopted pursuant to Chapter
3.5 (commencing with Section 11340) of Part 1 of Division 3 of
Title 2 of the Government Code, whichever occurs first.
(3) The new regulations are operative.
SEC. 2. This act is an urgency statute necessary for the
immediate preservation of the public peace, health, or safety within
the meaning of Article IV of the Constitution and shall go into
immediate effect. The facts constituting the necessity are:
The Department of Fish and Game is issuing permits for the
operation of vacuum or suction dredging equipment in violation
of a court order and the California Environmental Quality Act and
threatens water quality and at-risk fish and other species.

Robert Snyder is really Richard Sanders

We have just learned that Robert Snyder is really Richard Sanders of Roundup Montana. We followed the advise that we got from the FBI and contacted the officials here in California and were told that they could not do anything unless someone really showed up on my front door step. The local officials stated that this person really should not be making threats but there is no way to know if this person will ever show up here in California or New Mexico.

I do know a little bit about the law and how it should work. When a person makes a threat it is to be taken very seriously. Richard Sanders has a very bad record when it comes to violence. Homeland Security, ATF, FBI, Sheriff and the local police have a duty to protect. When 6 or 7 emails are sent to them complete with headers showing that threats have been made it becomes a serious matter. Gordon Walters has it in his head that I am the reason that his whole world is falling apart. Gordon Walters has Richard Sanders doing his dirty work for a percentage of a project that has gone down the tubes. Richard Sanders has been to Arrey, New Mexico and even hauled a few loads of ore to Virginia City, Montana. He even left Arrey, New Mexico leaving a $146.00 electric bill that one of my men had to pay. Gordon Walters is using Richard Sanders to spread all types of falsehoods and threats to get me to take down the information that has been provided on this site under the news.

The only thing that has happened is that it makes me just want to see to it that these people spend their time in a cross-bar hotel.

Treasures Unlimited and Treasures Unlimited II, etc

I have been receiving inquires as to Authorized Management Certificates and their vaidity. Because of a court action that was filed some years ago by myself on behalf of Tesoro Del Alma named Paul Blutter, Richard Rowland, Treasures Unlimited and Treasures Unlimited II, et al. the certificates are not valid and are not going to be recognized or honored by Tesoro Del Alma. Richard Rowland was notified by Judge Suchanek when the corporations were filed that they in fact were illegal and based upon fraud. When Richard Rowland took money that was suppose to go to Tesoro Del Alma and gave it to his son to help his son start a business in El Paso was fraud. There was a "RICO" action that was filed against Paul Blutter, Richard Rowland, Treasures Unlimited, Treasures Unlimited II, et al in 1996 which they lost. Tesoro Del Alma has voided all payorders that were issued by Tesoro Del Alma because of the activities of Paul Blutter, Richard Rowland, Treasures Unlimited, Treasure Unlimited II, et al. and on the advice of legal counsel. The Legal action was filed and heard in Fresno, California.
